Defense attorneys handling Lafayette cardiologist Mehmood Patel’s federal health care fraud case plan to file a motion to retry the case.
On Dec. 30, jurors found Patel guilty on 51 counts for performing “medically unnecessary” cardiac procedures - stents and angioplasties - on patients and billing federal health care and private insurance providers for them. Patel’s defense attorney Thomas Guilbeau said on Monday he along with his partner Michael Small were two days into preparing a motion for a new trial, which has to be filed within 10 days after a verdict is delivered.
Patel will remain free until his sentencing date, which could take more than two months pending the preparation of the pre-sentencing report and the new trial motion.
