The New Orleans Civil Service Commission has refused to overturn the firing of a police officer who was videotaped beating a man in the French Quarter in the aftermath of Hurricane Katrina.
The fired officer, Robert Evangelist, asked to be reinstated with back pay after a judge cleared him of criminal wrongdoing in the beating of 66-year-old Robert Davis. But the commission ruled Wednesday that Police Superintendent Warren Riley did not abuse his discretion in determining that Evangelist overreacted and used excessive force.
The commission granted the portion of Evangelist’s appeal in which he challenged his earlier 60-day suspension for an untruthfulness violation, but the panel denied the appeal of his firing.
